5. Use of Service
You agree to use the Service only for lawful purposes and in accordance with these Terms and all applicable laws. You will not, and will not permit any third party to:
- Use the Service in any manner that violates applicable telephony, privacy, or data protection regulations.
- Attempt to probe, scan, or test the vulnerability of any system or network, or breach any security or authentication measures.
- Use the Service to transmit spam, abusive content, or any material that is unlawful, harmful, or otherwise objectionable.
6. Data & Privacy
Our collection, use, and processing of personal data in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.
To the extent we act as a processor or service provider on your behalf, the parties may enter into additional data protection terms or agreements as required by applicable law.

7. AI Output & Limitations
PersonaDesk.ai leverages machine learning and large language models. AI-generated content may sometimes be incomplete, inaccurate, or inappropriate. You are responsible for reviewing, configuring, and supervising how the Service interacts with your callers and data.
You acknowledge and agree that:
- AI responses are probabilistic and may not always reflect your policies, instructions, or the most current information.
- You are responsible for configuring guardrails, escalation paths, and human handoff workflows appropriate for your use case and regulatory environment.
- The Service is not a substitute for professional advice (including medical, legal, or financial advice) and should not be solely relied upon for critical decisions.
8. Termination
Either party may terminate the Service in accordance with the terms of the applicable ordering document or subscription flow. We may suspend or terminate your access to the Service immediately if you materially breach these Terms or if we are required to do so by law or a governmental authority.
Upon termination, your right to use the Service will cease immediately, but provisions that by their nature should survive (such as ownership, confidentiality, indemnity, and limitations of liability) will remain in effect.
9. Disclaimers & Limitation of Liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, in no event will PersonaDesk.ai, its affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
Our aggregate liability arising out of or relating to these Terms or the Service will not exceed the amounts paid or payable by you for the Service in the twelve (12) months preceding the event giving rise to the claim.
